A coalition of United States-based pro-Biafra activists, the Rising Sun Foundation USA, has challenged Nigerian legal practitioners to produce any precedent of a court convicting an accused person with a repealed law. This challenge was informed by the argument advanced by the defence team of jailed Indigenous People of Biafra (IPOB) leader, Nnamdi Kanu, that his continued detention is based on a law that has been repealed. The activists argue that the practice of using repealed laws in court is a violation of the principle of fair hearing enshrined in the Nigerian constitution. According to Daily Post Nigeria, this challenge comes at a time when there are concerns about the fairness of the Nigerian judicial system, particularly in high-profile cases such as that of Nnamdi Kanu. The use of repealed laws in court proceedings could potentially undermine the legitimacy of the judicial process and the convictions obtained. It is unclear whether the Nigerian Bar Association (NBA) or the Ministry of Justice have responded to the challenge posed by the Rising Sun Foundation USA.
