In a significant move towards combating the proliferation of fake drugs in Nigeria, a Federal High Court in Lagos has convicted a trader, Elijah Chigbogu, and two firms – Shenzhen Huaxing Pharmaceutical Co. Ltd and Huiyuan International Trading Co. Ltd – for possessing, importing, and distributing unregistered drugs.
The court found them guilty of contravening the provisions of the National Agency for Food and Drug Administration and Control (NAFDAC) Act. The convictions follow an investigation by NAFDAC into reports of counterfeit pharmaceuticals being distributed in Lagos.
Elijah Chigbogu, who was the main distributor, was sentenced to five years’ imprisonment on each of the three counts. Shenzhen Huaxing Pharmaceutical Co. Ltd and Huiyuan International Trading Co. Ltd were fined N10 million ($25,000) each.
According to Punch Newspapers, this is not the first time such convictions have been secured by NAFDAC in its bid to protect Nigerians from the dangers of fake drugs. The agency has previously arrested and prosecuted several individuals and companies involved in peddling counterfeit pharmaceuticals.
The court’s decision underscores the importance of enforcing regulations aimed at ensuring the quality and safety of medicines in Nigeria. Fake or substandard drugs not only undermine public health but also contribute to the development of drug resistance, making it harder to treat diseases effectively.
This conviction serves as a warning to other unscrupulous individuals and companies engaged in this illegal activity. The Nigerian government is committed to taking decisive action against those who endanger the lives of citizens through the distribution of fake drugs.
